Can I make a claim
Yes, you have 3 years from the date of the accident in order to make a claim for personal injury.
The beauty industry follows the Health and Safety at Work Act 1974. This ensures that all workplaces must protect their staff and clients from risk. If chemicals are being used in beauty treatments which is often the case with hair colouring, compliance must be had with the Control of Substances hazardous to Health Regulations 2002.
All beauty establishments that use cosmetic products must comply with the Cosmetic Products (Safety) Regulations 2004 and they must use products that have been fully tested.
The difficulty with some types of beauty treatment including waxing is that the beauty industry is not currently regulated in the UK so staff who carry out waxing do not need qualifications to do so.
At Hodge Jones and Allen we represent clients who have suffered injuries as a result of beauty treatments that have not gone to plan.
Evidence to retain
It is worthwhile keeping evidence of the following to support a potential claim:-
- Photographs of injuries
- A written account of the treatment undertaken and what happened.
- GP and hospital records
- Request an accident report form to be completed
- Ask for a copy of the relevant public liability insurance cover
